Conservative news network Newsmax is suing Fox News for allegedly pressuring guests to not appear on its shows in a bid to edge out the competition.
The federal antitrust lawsuit, filed in US District Court in south Florida Wednesday, claims that Fox News hired private detectives to investigate Newsmax executives as part of a plot to maintain a monopoly over right-leaning viewers.
The complaint said the alleged tactics from Fox created an 'unlawful monopolization' of the conservative pay TV news Market.
'Fox may have profited from exclusionary contracts and intimidation tactics for years, but those days are over,' Newsmax founder and CEO Christopher Ruddy said in a statement.
The suit accuses Fox News of trying to deliberately block Newsmax from growing platforms like Hulu, Sling and Fubo, and says it forces its distributors either not to carry its competitors or make it hard to find them.
It further alleges that the Rupert-Murdoch-owned network used an agency to set up social media accounts to attack Ruddy directly.
Fox News claimed the suit came about because of Newsmax's lack of success.
'Newsmax cannot sue their way out of their own competitive failures in the marketplace to chase headlines simply because they can’t attract viewers,' the network said in a statement.



Newsmax, which has broadcast since 2014, went public on the New York Stock Exchange this past April.
Anchors at the network include former Fox News hosts Greta Van Susteren and Greg Kelly.
Its ratings remain well behind Fox News, which finished August as the number one network in primetime television for the summer.
It averaged 2,432,000 viewers in Monday-Sunday primetime from June 20 until Labor Day, beating out ABC (2,376,000 viewers), NBC (2,208,000 viewers) and CBS (2,028,000 viewers).
While Newsmax has never closed in on Fox in ratings, court papers related to a lawsuit filed in the wake of the 2020 election showed Fox executives showing concern its rival would eventually take advantage of viewer dissatisfaction following Donald Trump's election loss.
'Since the inception of Newsmax's cable channel, Newsmax has faced threats and smear intimidation tactics to hurt or undermine the company and its executives,' Wednesday's lawsuit read.
The suit also claims that Fox's success enables it to charge distributors 'outsized' fees to carry the network.
When Newsmax confronted Fox regarding anti-competitive conduct, the network allegedly responded: 'welcome to the big leagues,' the suit adds.
